Two Issues on the Mortgage of Forest Rights

摘要:

林权抵押是集体林权改革的重要环节,急需理论回应。中国对抵押物转让进行了限制规定,这主要是基于理论原理和价值考量两个方面,但此种限制抵押物转让的理由不足成立。作为一种特殊的抵押物,抵押林权应可以自由转让,林权抵押实践为抵押物自由转让提供了进一步佐证。林地与林木是两项独立的不动产,在设定抵押方面,应认为构成两项抵押,至于一并抵押或是分别抵押应尊重抵押人的自由决定。林权抵押制度设计应在主体间进行充分的利益衡量,不能过于偏重抵押权人。

Abstract:

Mortgage of forest rights, the important link in the collective forest rights reform, is in the urgent need of theoretical support. China has set restrictions on the transfer of mortgaged real estate out of the consideration of theory and cost. As a special mortgaged real estate, the mortgage of forest rights should be transferred in a free way, for the practice of which has proved the necessity of free mortgaged real estate. It is up to the mortgagor to decide whether land and forest are mortgaged together or respectively, because land and forest are two independent real estates. The mortgage system should avoid being partial to the mortgagee to fully balance the interest.
