摘要：

1967年《外空条约》生效至今恰好四十年,值此时机有必要总结国际空间法的现状,并展望其发展趋向。自1961年以来,在联合国和平利用外层空间委员会(外空委)的主持下,国际空间立法成就斐然,初步建立起国际空间法律体系。但国际空间法也面临着诸多问题,部分缘于自身的缺陷,更多的是空间活动的深入发展和性质变化带来的冲击。种种现象表明,国际空间法日益呈现软法化和分散化的发展趋势,应当顺应发展趋势解决有关的问题。

Abstract:

It is necessary to summarize the current situation and prospect of international space law at the moment when the 1967 Outer Space Treaty has entered into force for forty years. Since 1961, great achievements have been made in the lawmaking of international space law, and the jurisprudence of international space law ha s been established in the framework of United Nations Committee on the Peaceful Uses of Outer Space. However, the development of international space law has enc ountered some problems, partly due to its own defects, but most of which derives from the challenges brought by the rapid change and development of outer space activities. International space law is increasingly representing in soft law wit h the decentralized rule makers. Therefore, the relevant problems should be reso lved in conformity with its trend in development.
