摘要/Abstract

摘要：

在分析执行专利保护制度的交易成本和专利保护对创新活动激励的基础上,阐述了对片面追求过高专利保护应持谨慎态度,并指出应根据专利保护的效果和经济科技发展的水平采取适当的保护程度,同时对中国现阶段知识产权保护提出了一些原则性建议。

关键词: 专利制度, 知识产权, 创新, 交易成本

Abstract:

By analyzing the transaction expense of patent protection and the incentive effe ct on innovation, the article states that patent system should not be regarded as a institution playing a wholly positive role in the protection which, based on the current development of economy and technology, should be properly grante d. The article also puts forth some reasonable advice of principle.
