航空器所有权"登记对抗效力"的辨析

摘要:

航空器所有权变动多采取交付生效的立法模式,其登记公示力仅为"对抗效力".中国《民用航空法》第14条对登记效力的规定存在理解上的歧义,但可通过体系解释方法予以阐明.航空器的登记效力得到明确后,登记对抗理论中的"对抗"和"第三人"含义还有待于进一步探讨.在中国法律语境下,航空器所有权登记对抗中"对抗"一词的内涵采日本学说中的"相对无效说"较为适宜.在对于第三人范围的界定方面,中国《民用航空法》不妨借鉴《法国民法典》和中国《物权法》中的相关规定,对其施加更谨慎的注意义务.

Abstract:

Transference of aircraft ownership takes effective after delivery in legislative mode in general. The effect of registration is to act against a third party. But there are different understandings of registration antagonism according to the Civil Aviation Law in China, which can be clarified in the system of law, though the exact meaning of "against" and "third party" is still subject to further discussion. The theory of relative invalidity in Japan accords to the meaning of registration confrontation in the legal system of China. To define the scope of the third party, the Civil Aviation Law of China can learn from the French Civil Code and the Property Law in China to impose more obligations on the legitimacy of the aircraft ownership.
