共同但有区别责任原则与空间碎片减缓

The Principle of Common-but-differentiated Responsibilities and Space Debris Mitigation

  • 摘要: 共同但有区别责任原则在国际环境法领域起到了很重要的作用。在空间碎片减缓领域,适用共同但有区别责任原则既有必要性,又有可行性。具体而言,在空间碎片减缓问题上,适用这一原则包括各国均负有减缓空间碎片的共同义务,应为各国设定必须遵循的最低减缓标准,应根据各国不同情况实行差别待遇,航天大国应在资金和技术上给予发展中国家以必要支持几方面含义。

     

    Abstract: The principle of common-but-differentiated responsibilities (CBDR) has played a very important role in the field of international environmental law. It is both necessary and feasible to apply the principle to address the issues of space debris mitigation. Specifically, in the field of space debris mitigation, application of this principle include the following meanings: all countries have common obligations to mitigate space debris, a minimum mitigation standards must be followed by all countries, differential treatment should be implemented according to different national circumstances, space powers should give developing countries the necessary financial and technical support.
