美国案例教学视域下法学本科教学方式之改革

Reform of Teaching Methods of Undergraduate Education in Law from the Perspective of American Case Teaching

  • 摘要: 美国案例教学法所具有的一定普适性以及两大法系的逐渐融合,虽然为中国借鉴美国案例教学法奠定了一定的可行性基础,但是中美两国法律制度和教育体制的差异,使得中国不能直接移植美国案例教学法。虽然不能直接采用美国案例教学法之"形",但美国案例教学法之"核",即"让学生像律师一样思考",培养学生的思辨和实务能力,却可以跨越这种差异,为中国法学本科教学所借鉴。以美国案例教学法之"核"为视角,审视中国法学本科教学,目前中国的法学本科教学在授课方式、教学案例选择等方面都有待转变和努力。

     

    Abstract: Although reforming China's teaching methods of undergraduate education in law from the perspective of American case teaching is practicable because of its universality and the trend of blending the two legal chains, the difference between the two countries' legal systems make it impossible to transplant it directly. However, the spirit of guiding students in thinking like lawyers is universal, because there is no border in the method of cultivating students' thinking abilities. Examined from the view of American case teaching, the current undergraduate education in lawin China, in such aspects as the method of teaching and the selection of teaching cases, remains to be improved.
