Study on the List of Unruly Behaviors of the Tokyo Convention

摘要: 在国际民用航空组织的组织下,历经3年《东京公约》现代化最终取得了成果,通过了2014年《蒙特利尔议定书》.其中,不循规行为类别是议定书制定过程中最具争议的问题之一.经过多次研讨和专家的研究,最终在新议定书第15条之二中列举了最受关注和危害性较大的不循规行为,同时发布了对国际民航组织颁布的第288号通告进行更新的决议.中国依据本国实际情况,参考新议定书及相关通告的要求,在近期的立法中,将更多的不循规行为纳入立法,加大对此类行为的处置.Abstract: After three years' hard work organized by ICAO (International Civil Aviation Organization), The Protocol to Amend the Convention on Offences and Certain Other Acts Committed on Board Aircraft (The Montreal Protocol, 2014) was adopted in 2014 as the outcome of Tokyo Convention's modernization. List of unruly behaviors is one controversial topic in the drawing up of The Montreal Protocol. The biggest concerns and most serious behaviors are finally listed in the Article 15 bis. The resolution to update the Circular 288 issued by ICAO was also announced. In reference to the Montreal Protocol and Circular 288, China includes more types of unruly behaviors into the revision of domestic provisions to deal more effectively with these behaviors.
