未成年人网络保护制度的域外经验与启示

Reflections on Foreign Legislation of Minors Online Protection

  • 摘要: 在网络化时代,未成年人在商家的花样营销面前几乎是毫无抵抗力的,很容易在外界的诱惑之下向他人披露其个人信息,从而使其暴露在商业或性侵害的风险之下。因此,有必要对未成年人实施网络特别保护措施,以保护其个人隐私,并避免其在上网时接触到不良信息或受到伤害。美国、英国、日本等国在该领域有许多立法经验值得中国借鉴。一方面,他们都关注儿童相关利益受特别保护的重要性;另一方面,坚持"熟悉使用互联网将是在21世纪获得成功的必备技能"的认识,都没有通过禁止儿童上网的方式,而是通过规范网络经营者的行为方式等来实施保护。鉴于网络的国际化特点,在未成年人网络保护问题上,特别是对网络信息包括色情信息进行监管方面,亟需国际合作;但是,各国认定色情或淫秽信息的标准不一致,导致这种合作的困难和复杂。此外,未成年人网络保护体系中,互联网行业自律,特别是网络平台发挥着重要的作用。

     

    Abstract: It is necessary to take some protection measures for the minors to protect their online privacy and prevent them accessing the harmful information when they are online. Chinese legislators can learn lots of experiences from the minors online protection legislation of US, UK and Japan. The international cooperation is necessary and important in the field of regulation of network information, especially the pornographic information, however, the definition of pornography or obscenity is different among the countries in the world. In the regulatory system of minors online protection, the self-regulation of internet service providers, especially the internet platform, plays an important role.
