Abstract:
The application of the cross-exemption liability system in the International Space Station not only evades some jurisdictional disputes over the International Space Station, but also avoids the litigation between the member States of the International Space Station and related entities. Under the legal framework of outer space activities and in the construction and operation of the International Space Station, the cross-exemption liability system has become a new system of liability sharing, and has been widely used in the field of space station. As a space power that has completed the construction of its space station independently, China can learn from the cross-exemption liability system which has proved its practical value in the International Space Station, when formulating the liability system for the compensation of damages of the Chinese Space Station. However, based on the differences between the Chinese Space Station and the International Space Station, the liability system should be modified and improved properly, which will enable the participants of the Chinese Space Station to maintain a prudent attitude at all times to reduce the occurrence of damages, and establish a multi-mode cross-exemption liability system and a variety of corresponding remedy approaches. Meanwhile, more countries and relevant entities can be attracted to participate, thus promoting the international cooperation of the Chinese Space Station.
