行为法学视角下算法管理的异化与矫治

Alienation and Correction of Algorithmic Management from the Perspective of Behavioral Law

  • 摘要: 算法管理系指企业管理行为的算法化,是企业管理方式上的一种创新。然而,由于企业盲目逐利,算法管理逐渐异化为其向平台劳动者攫取利益的工具。具体表现为:其一,引起劳动关系的混乱,平台企业借此规避用工责任;其二,劳动基准被击穿,劳动者丧失基本劳动保护;其三,企业奖惩权沦为剥削工具,劳动者遭遇规则侵权。对此,行为法学主张从合法行为激励模式和违法行为惩罚模式来促使企业正确运用算法管理模式。诸如,制定合规指南,引入合规激励措施;改进劳动监察执法机制等。如此,既可以提高企业的生产效率,又不至于使平台从业者的合法权益丧失保障。

     

    Abstract: Algorithmic management refers to the algorithmization of enterprise management practices, which is an innovation in enterprise management methods. However, due to the blind pursuit of profit by enterprises, algorithmic management has gradually become alienated as a tool to obtain benefits from platform workers. This alienation is manifested in the following ways. First, algorithmic management causes chaos in labor relations, and is used by platform companies to avoid employment responsibilities. Second, this management undermines the labor standards, resulting in the loss of basic labor protection for workers. Third, corporate rewards and punishments have become tools of exploitation, so workers are subject to rule violations. To address these problems, behavioral jurisprudence advocates that companies should use the algorithmic management model correctly through the incentive model of legal behaviors and the punishment model of illegal behaviors. Recommended measures include formulating compliance guidelines, introducing compliance incentives, and improving labor inspection and law enforcement mechanisms. These measures can not only improve the production efficiency of enterprises, but also prevent the loss of the legitimate rights and interests of platform practitioners.
