Abstract:
Algorithmic management refers to the algorithmization of enterprise management behavior, which is an innovation in enterprise management methods. However, due to the blind pursuit of profit by enterprises, algorithm management has gradually become alienated as a tool to obtain benefits from platform workers. The specific manifestations are as follows: first, it causes chaos in labor relations, and platform companies use this to avoid employment responsibilities; second, labor benchmarks are broken down, and workers lose basic labor protection; third, corporate rewards and punishments have become tools of exploitation, and workers are subject to rule violations. In this regard, behavioral jurisprudence advocates that companies should use the algorithmic management model correctly from the incentive model of legal behavior and the punishment model of illegal behavior. For example, formulating compliance guidelines and introduce compliance incentives; improving labor inspection and law enforcement mechanisms, etc. In this way, the production efficiency of enterprises can be improved, and the legitimate rights and interests of platform practitioners will not be lost.
