Abstract:
The year 2023 is a key year for further improving the recording and review system, whose work deployment includes amending the Legislative Law of the People’s Republic of China and the Law of the People’s Republic of China on the Supervision of Standing Committees of People’s Congresses at Various Levels, and studying and introducing the Decision of the Standing Committee of National People’s Congress on Improving and Strengthening the Recording and Review System. Taking the types of review as an example, the paper sorts out their logic of work practice and empirical knowledge respectively from the relevant contents of each annual report on the status of the recording and review work, and sums up the connotative structure of their work mechanism from the chapters on the types of review in Measures for the Recording and Review of Regulations and Judicial Interpretations in 2019. In addition, the paper reveals the track into law of the legal system and its normative connotation by comparing the amendments to the provisions of all four types of review types through the second amendment of the Legislative Law of the People’s Republic of China. The paper also finds that the path of “working practice-working mechanism-legal norms” for the institutionalization of the types of review can become a typical path for the normalization and proceduralization of the whole system of constitutional supervision, and provide phased reference and carrier reference for sorting out and summarizing their normative connotations.
