人工智能问责制的法理界定与优化路径

  • 摘要: 传统人工智能治理研究多聚焦技术伦理或法律规制的单一路径,未能有效回应算法自主性、系统复杂性和社会渗透性引发的规制困境,尤其在责任归属认定、因果关系追溯等核心内容上存在理论供给与实践需求的断裂。面对数字权力重构与社会风险扩散的双重挑战,有必要系统探讨“问责制”在人工智能治理中的法理构造与制度回应,构建适应技术风险特征的责任分配框架。通过法理界定的理论考察,可厘清问责制作为复合型治理工具的本质,并从发展逻辑维度揭示问责制的演进方向。在制度构建层面,归责原则需实现从过错责任到能力本位责任的模式转换,通过技术标准的法律化重构权责匹配机制。主体结构应构建穿透技术黑箱的多元共治框架,强化政府监管、行业自律与社会监督的协同效应。同时,推动可解释人工智能、区块链存证等技术工具与法律规则的深度融合,形成覆盖算法全生命周期的动态规制体系。

     

    Abstract: Traditional research on AI governance often focuses on a single approach, either technological ethics or legal regulation, failing to effectively address the regulatory dilemmas arising from algorithmic autonomy, systemic complexity, and societal pervasiveness. This is particularly evident in the disjunction between theoretical supply and practical needs concerning core issues such as responsibility attribution and causality tracing. Faced with the dual challenges of reconfigured digital power and dispersed societal risks, it is necessary to systematically explore the jurisprudential construction and institutional responses of "accountability system" within AI governance, building a responsibility allocation framework adapted to the characteristics of technological risks. Through a theoretical examination of the jurisprudential definition, the essence of the accountability system as a composite governance tool can be clarified, and its evolutionary direction can be revealed from the perspective of developmental logic. At the institutional level, the liability principle must transition from fault-based liability to a capacity-based liability model, reconstructing the authority-responsibility alignment mechanism through the legal codification of technical standards. The governance structure should establish a multi-stakeholder framework capable of penetrating technological black boxes, enhancing synergies among governmental oversight, industry self-regulation, and societal supervision. Meanwhile, promoting the deep integration of technical tools (e.g., explainable AI and blockchain-based evidence preservation) with legal rules will forge a dynamic regulatory system covering the entire algorithm lifecycle.
