Some Legal Issues on Space Tourism

摘要: 现行国际空间法对空间旅游中的游客的法律地位及空间旅游产生的相关国际责任没有明确的直接规定。根据《维也纳条约法公约》有关条约解释和协调条约冲突的规则,空间游客也应属于现行空间营救制度下的被营救对象。空间旅游中产生的国际责任主要包括空间旅游组织者对游客造成损害的国际责任、空间旅游组织者对他国造成损害的国际责任及空间游客造成损害产生的国际责任,这些国际责任制度亟待进一步完善和发展。Abstract: Existing international space law doesn-t directly provide the status of space tourists and the international responsibility in space tourism. According to the regulations on the interpretation of treaty and the conflicts of treaty in the Vienna Convention on the Law of Treaties, space tourists may be the objects of space rescue system. International responsibility arising from space tourism includes international liability for damage by the organizer of space tourism to space tourists and international liability for damage by the organizer to other states and the international liability for damage to the space tourists. The legal system on international liability should be perfected and developed.
