摘要: 航天保险法律制度是航天发射业健康发展的重要保障。航天保险法律制度有国际法和国内法两种渊源,其主要内容包括航天保险的类型、航天保险合同制度及航天保险监管制度。中国航天保险立法存在基本法缺位、航天保险定性模糊及配套法律规定不足等缺陷,故亟需完善。

Abstract: The space insurance legislation is very important for the healthy deve lopment of the space launch industry. The space insurance legal system consists of the international law and the domestic law, and it includes the space insuran ce category, the contract law and the regulation law. There are many faults in t he current space insurance legislation in China, including the absence of the ba sic space insurance law, the obscure identification on the space insurance, and the absence of other relevant supporting regulations, therefore, this area needs speedy improvement.
