Study on the Environmental Liability Insurance Legal System in China

摘要: 中国重大的环境污染事故频发,具有"分散风险功能"的环境责任保险制度是促进环境侵权赔偿社会化和化解环境侵权救济困境的有效手段。文章就环境责任保险的法制建设、责任范围、承保机构、运作模式等方面进行了研究,通过国内外在以上方面的比较分析,得到中国存在的不足,对完善中国的环境责任保险制度提出了建议,这对尽快建立适合中国国情的环境责任保险制度具有积极意义。

Abstract: The current situation of environment of China is so severe that serious environm ental pollution accidents have frequently happened. How to hunt for balance betw een protecting victims’ legal rights and making the enterprise more efficiently operated is a hard nut that embarrasses the environmental academia. As an effec tive measure to accelerate the socialization of the liability of compensation fo r environmental tort and solve the dilemma in the remedy for environmental tort, environmental liability insurance legal system appears in time. This article di scusses the construction of legal system, scope of cover, approved organization and operation model to present good suggestions for building environmental liabi lity insurance legal system in China.
