中日司法制度改革之法理要义比较

Comparison of Judicial Reforms between China and Japan

摘要: 现在各国都在进行司法改革,努力摸索出有利于本国法治发展的司法改革的理念、方式、结构体系等的司法改革框架。各国都有不同司法改革前提性的社会和人文等方面的背景,但是基于司法改革的共性,也可以在比较和评价其他国家司法改革发展理论过程的基础上,借鉴可以为中国所利用的其他国家司法改革中的闪光之处。基于该宗旨,文章介绍并希望借鉴日本司法改革过程中注重指导思想和理念对整个司法改革的引领作用。

Abstract: Many countries are taking on judicial reform, which are all trying to find its framework including ideal, method, and structural system to develop rule of law better. On the basis of commonness in judicial reform, China can learn from other countries' experience in comparing and evaluating. The paper points out that Japanese way in judicial reform is worthy of our notice.
