中国民商事审判中合意选择法官制度之理性分析

摘要: 2003年,台湾地区创造性地设立了当事人合意选择法官制度,该项制度能否在中国大陆地区实行成为当前民事诉讼法修改中的一个热门话题。论文主要论述合意选择法官制度的法理基础,以及在民商事审判中引入该项制度的可行性,最后探讨了该项制度在中国民商事审判中的具体实施问题。

Abstract: In 2003,the system of jointly selecting judges by litigant was set up in Taiwan, it is a popular topic whether the above system is feasible in the mainland of C hina. This text mainly discusses the legal principle of the above system, whethe r the above system is feasible in the mainland of China, and the enforcement of the above system in our commercial process.
