摘要: 在法治政府已成为构建现代政府的目标范式的背景下,从思想史的视角系统透视法治政府理论的法理基础便成为一种智识上的基本需要。文章意以洛克《政府论》作为分析文本,从洛克本人的生平及《政府论》的写作背景、自然状态向市民政府的转化、财产理论等方面,系统分析洛克的有限政府理论,探究法治政府理论的法理基础,从而为法治政府理论的建构与完善提供一个思想史的注脚。

Abstract: As the construction of a government ruled by law has become a paradigm of modern governments, it is of intellectual necessity to analyze the legal bases of Theory on Government Ruled by Law in the perspective of thought history. In Second Treatise of Government, Locke demonstrated the transformation from natural state to civil government and related property theory, and expounded systematically limited government theory on the base of foregoing theories, thus provided practical and realistic theoretical bases for modern liberal states and governments ruled by law, which played a far-reaching influence on modern Theory of Government Ruled by Law.
