A Study on the Legislation Issues of Airport Noise Abatement in China

摘要: 当前中国机场噪声污染问题较为严重,造成该问题的主要原因之一是相关立法起步晚、发展慢、不健全,使得机场噪声污染防治工作缺乏切实有效的法律规定可依。为解决此问题,当务之急是整合现有相关规定,借鉴国际通行做法,考虑中国现实国情,构建由"原则规定—基本制度—配套规则"组成的机场噪声污染防治法律制度体系。这其中又以确立与完善合理规划制度、机场噪声监测制度、机场减噪收费制度等基本制度为重点。

Abstract: Nowadays, airport noise pollution is serious in China. One of the reasons accounting for this situation is that there are many deficiencies in related legislations, resulting in lack of adequate legal basis in abatement of airport noise. Therefore, in order to control airport noise, the most important thing to do is to arrange existing regulations and establish the legal system of airport noise abatement, using the experience of other countries for reference and combining our national conditions. The legal system of airport noise abatement consists of fundamental principals, basic systems and supporting regulations. Some basic systems, such as making reasonable plan system, airport noise monitoring system, charging for airport noise system and so on, should be established and perfected at first.
