Research on the Theory and Practice Problems of Archives Ownership

摘要: 档案所有权是指档案所有人依法对自己所拥有的档案财产享有占有、使用、收益和处分的权利。档案占有权是保管机构对档案的实际占有,开放是档案使用权的一项重要内容,利用者是最大受益方,国家对国有档案财产收益权采取了放弃做法,国家档案部门依法对国有档案享有开放、公布、鉴定、销毁、出售等处分权。档案所有权是档案合法利用的法律基础,是国家档案资源合理配置的重要参考依据。Abstract: The archive ownership is refer to the archive properties rights of possessing, accessing, proceeds and disposition by the archive owner judicially. The right of archive possessing means the preserving institution possesses the archives in fact. Opening archives to society is the important content of the archives accessing and the archives user gains the biggest benefit. The nation gives up the proceeds right of national archive property. The national archives have the rights just as archives opening to society, publication, appraisal, destruction and selling by the law. The archive ownership is the law foundation of the archives accessing legality and the important reference of the national archives resources collocating rationality.
