A Study of Aviation Component Manufacturers'Liability

摘要: 采纳法条类型理论的方法,将参与航空零部件本身设计和参与航空零部件同航空器整合设计的零部件供应商归类为独立航空零部件供应商。将未参与前述两项设计中的任意一项,或者两项设计均未参加的供应商归类为关联航空零部件供应商。前者同航空器制造商具有相同本质,后者则不具有。就产品的设计缺陷和警示缺陷而言,独立航空零部件供应商承担严格责任,关联航空零部件供应商承担过错责任;但就航空零部件的制造缺陷而言,两种供应商都应当承担严格责任。

Abstract: Adopting legal type theory, the paper classifies the component part suppliers which participate in the design of the component and its integration to the aircraft as independent component suppliers. They share the nature of that of aviation manufacturers and that shall assume strict liability in design defect and warning defect. Those which do not participate in either of the design processes are classified as dependent component supplier. They do not share aviation manufaturers'nature and shall assume negligence liability in design defect and warning defect. The paper holds, however, that these suppliers shall all assume strict liability in manufacturing defect. -
