民用无人机运行事故致害法律责任探究

Legal Liability Identification of the Damage Caused by Civil UAVs Operation Accidents

  • 摘要: 通过梳理民用无人机相关法律规章和中国《侵权责任法》的有关规定,可知中国确立无人机损害责任的规范是以"所有人负责主义"为基本立场的。但考虑到无人机的所有、占有形式相分离的情况,笔者认为在无人机责任主体认定时应采用多元责任主体原则,按不同情形进行进一步规定。一方面,一般情况下优先由无人机所有人承担责任;另一方面,不同情况下应认定无人机占有人与其他责任人承担追偿或连带关系。

     

    Abstract: By sorting out documents and regulations on civil UAVs, we may know that our country establishes the fundamental principle that aircraft owners should be responsible for damage caused by civil UAVs. But considering the condition that the ownership and the authority of operation are usually separated, this paper proposed that multiple subjects should be adopted in the liability identification:firstly, the owner has the prior responsibility for damage caused by UAVs; Secondly, the operators and other responsible persons should bear the recovery or joint relationship according to different situations.
