Probing into the Issue of the Jurisdiction of the Cases of Compensation for International Air Crash

摘要: 随着航空运输迅速发展,国际空难赔偿案件日益增多,而每一起案件的解决都关系到管辖权问题。文章从区分国内空难案件与国际空难案件入手,对1929年华沙公约所规定的四种管辖权以及1999年蒙特利尔公约增加的第五种管辖权进行了分析,并在此基础上,探讨了中国法院确定国际空难赔偿案件管辖权的依据。

Abstract: With the rapid development of air transport, the cases of compensation for inter national air crash are increasingly enlarged, and the issue of the jurisdiction relates to the determination of each case .This paper starts with differentiati ng between domestic air crash cases and international air crash cases, then anal yses the four kinds of jurisdiction provided by the Warsaw Convention 1929,an d the fifth jurisdiction added by the Montreal Convention 1999, in the end it di scusses the grounds upon which Chinese domestic courts determine the jurisdictio n of international air crash cases on top of this.
