Comments on the EU-s Draft Code of Conduct for Outer Space Activities

摘要: 2008年12月,欧盟理事会通过了外层空间活动行为准则的初步案文草案。随即,欧盟向包括中国在内的其他国家征求意见。通过对该文件的内容加以分析,就中国政府如何应对欧盟的磋商请求提出了建议。总体上看,该文件具有自愿性,对中国没有约束力。如经适当修改, 可以作为一份执行联合国有关外空条约和决议的备忘录而赋予其一定的国际法地位和约束力。

Abstract: On 8 December, 2008, the Council of the European Union approved an initial draft text of the Code of Conduct for Outer Space Activities. Thereupon, the European Union invited other countries, including China, to give comments on the draft Code. Through an analysis of the text of the document, the author made a proposal for Chinese government to cope with the EU-s consultation request. Taken as a whole, the document has no binding effect to China because of its voluntary nature. However, if revised appropriately, this document could be considered as a memorandum for promoting and implementing UN space treaties and resolutions which will have a due status and constraint force in international law.
