Observing the Criminal Ideology of Legislation and Justices from the Emergence of SARS

  • 摘要: 突发SARS事件使中国经验主义的刑事立法理念和被动僵化的刑事司法理念得到了充分的彰显。基于这一突发公共危机带给我们的经验和教训,中国刑事立法和司法机关应彻底转变理念,实现刑法立法的超前性和刑事司法的活法化。

     

    Abstract: the emergence of SARS shows its iceberg in the criminal ideology of empirical legislation and rigidified justices as well. As being challenged to the issues, we would change the ideas to the criminal lawmakers and judicial bureaucracy by all which would foresee in the legislation and activate the criminal judicatory.
