On the Classification of Legal Liabilities for Damages Caused by Space Debris

  • 摘要: 当空间碎片造成损害,需要处理相应的责任问题时,应当根据具体的损害情形和适用法律的不同,将损害责任划分为不同的类型。其中包括纯粹国际法上的损害责任、纯粹国内法上的损害责任,以及国际法和国内法竞合型的损害责任。正确划分空间碎片损害责任的类型,对于最终确定法律责任具有重要影响。

     

    Abstract: Liabilities for damages caused by space debris should be classified on account of concrete situations and applicable laws, when dealing with legal liability issues in case of damages. There are three types of liability, i.e., liability for damages on international law, liability for damages on domestic law, and liability on both international and domestic laws. The correct classification may have important influence on the determination of the legal liability.
