摘要

摘要: 《国际空间站合作协议》为国际空间站这一迄今为止规模最大的空间合作项目确立了法律框架。国际空间站的法律既继承了现有联合国五大外空条约的原则和规则,又通过交叉豁免制度、刑事管辖权规定、国际空间站上产生的知识产权保护等制度丰富了国际空间法的内容。国际空间站的法律框架为国际空间合作提供了法律范本,也为空间商业化利用订立了基本规则,对中国的空间活动立法具有启示作用。

Abstract: Intergovernmental Agreement of the International Space Station established the legal framework for ISS, the largest space cooperation in the human history. The law of ISS complies with the principles and provisions of the existing five UN outer space treaties. It also developed the outer space law by the cross-waiver of liabilities, the criminal jurisdiction provision and the protection of intellectual property rights arising in/on the ISS. The ISS legal framework can be taken as a model for the law of international space cooperation. It also provides basic rules for commercial use of the outer space. It may be used as reference for China's lawmaking on space activities.
