On the Coordination of Liability Limits Related to Delay between China Aviation Law and Warsaw Convention System

  • 摘要: 华沙公约体系特别规定了旅客运输延误责任限额,中国的航空法体系没有将其与旅客人身伤亡赔偿限额进行区分。中国航空法体系对赔偿责任限额的计算单位与具体国家货币换算所规定的折算方法与华沙公约体系不符,涉及折算货币的规定亦不适当。文章在分析中国航空法体系与国际华沙公约体系的有关规定基础上,对延误的赔偿责任限额制度的有关具体问题予以明晰,以期为中国修改航空法有关规定,实现与华沙公约体系无缝对接提供建议。

     

    Abstract: Liability limits related to delay in the carriage of persons is specified in the Warsaw Convention System while China Aviation Law does not distinguish that from liability limits in case of death or injury of passengers in its provisions. The method for conversion of the monetary units with national currencies prescribed in China Aviation Law does not comply with the Warsaw Convention System and the wording of the specific type of currencies is also inappropriate. Based on the analysis of related provisions in China Aviation Law and the Warsaw Convention System, this essay clarifies the provision of liability limits related to delay, and provides suggestions to the amendment of China Aviation Law, making it coordinated with the Warsaw Convention System China has contracted.
