The Basic Methods of Identifying the Facts of Constitutive Elements of a Crime: in the Perspective of Legal Thinking

  • 摘要: 犯罪构成要件事实的认定是定罪过程中最关键的环节,以法律思维方式为视角,探讨了构成要件实事认定的基本方法,认为在认定构成要件事实的过程中,应该从规范到事实、从形式到实质、从客观到主观、从类型到特殊,谨慎地认定案件事实。

     

    Abstract: The identification of the facts of constitutive elements of a crime is the most crucial part in the procedure of conviction. This article discusses the basic methods of the identification mentioned above in the perspective of legal thinking. In that process, it should identify carefully from norms to facts, form to essence, objective to subjective, and typical to special.
