Law in Social Theory: Origins, Theories and Questions

  • The Law in social theory is the study of law from the perspective of social theory. It comes from the absorption and study of social theory by a group of historic jurists in China after the reform and opening up. It has the characteristics of macroscopic investigation of law phenomena from two dimensions of space and time. The law in social theory, combined with the Chinese context, has gradually formed the awareness of five core issues. They are the modernity of law, the globalization of law, the cross-civilization comparison and dialogue of law, the function and significance of law and the freedom and liberation of human beings.
