On the Basic Problems of the Legislation of Personal Information Protection

Chinese future legislation should clarify the following basic problems:first, the definition of personal information should be based on the relative relationship between the personal information subject and the information controller; second, the nature of the individual's right to the personal information is a kind of interests protected by law instead of the kind of absolute rights; third, the future legislation of personal information protection should focus on the regulation of public bodies and the enterprise. The future legislation should facilitate the coordination between the public legal rues and private legal rules.
