Status Quo, Problem and Development of Property Rights of Aircraft in Chinese Law

  • As special rights in rem, aircraft rights refer to international treaties on aircraft rights, which are deeply influenced by Anglo-American property law, and has a deep brand of Anglo-American property law. Promulgated prior to the Property Law of the People's Republic of China, Civil Aviation Law of the People's Republic of China still has imperfections, and cannot fully meet the needs of aircraft financing transactions and cross-border transactions. Therefore, there is urgent need for the comprehensive modernization and upgrading of China 's civil aircraft rights system with the connotation of "the buyer 's claim of the right to acquire aircraft" being incorporated into aircraft rights, so that more comprehensive protection can be provided to the secured party of aircraft.
