Issue on Punitive Damages Responsibility of Intellectual Property Rights

In the system of common laws, especially in American laws, punitive da mage responsibility is an important institution .In present China, the courts ge nerally apply punitive compensative damage responsibility in determining the ran ge of responsibility of torts, which includes compensative and punitive responsi bilities. The author argues that apart from compensative damages responsibility ,it is necessary to introduce the punitive damage responsibility into the pract ice of laws because of the particularity of intellectual ownership, and in the a pplication of this, the conditions and the compensative amount must be taken int o consideration.
