  • The essence of the Constitution consists in the guarantee of human rights, so h uman rights protected in criminal procedure is bound to be a focus of the Constitution and a crucial component of the fundamental human rights. Human rights protectedin criminal procedure in the foreign constitutions mainly includ e the right to the presumption of innocence, the right to punishment free of ill egal mandate, the right of defense, the right to bail, the right to prove one's own guilt under no coercion, the right to a fair trial, etc. These rights are of great significance for protecting human rights of people in general and defenda nts in particular.
