New Discussion about the Meanings of the Mitigated Punishment

  • The prevailing opinion holds that a mitigated punishment should differ from a lighter punishment, so that lighter punishment is referred to sentence a punishment within the limits of the prescribed punishment. While mitigated punishment is referred to sentence a punishment less than the prescribed punishment. This viewpoint is reasonable in the current legislation. However, the current legislation about lighter punishment and mitigated punishment mistakes their aims, which are not judged arbitrarily, but regulated in the criminal law as a method problem, especially to the mitigated punishment.
