Studies on International Climate Change Legislation Trend and Chinese Countermeasures:from the View of the GHG Reduction of International Aviation

The paper selected DIRECTIVE 2008/101/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL as the study object, adopted the cause analysis method, the objective analysis method, and the validity analysis method, and evaluated the European Union-s tactics, strategies and the effects. The research results indicated that the EU had made full use of the mechanisms and systems in the United Nations Framework Convention on Climate Change (UNFCCC) and the Kyoto Protocol, promoted international aviation emissions reduction, weakened the law efficacy of the "common but differentiated responsibilities" principle, transferred the international reduction pressure into the countries such as China and the United States. Also the EU had won the initiative of the international climate legislation arrangement. And China's civil aviation industry and the basic negotiation positions were strongly impacted. So China needs to safeguard its national strategic interests from the highly scientific point.
