Research on the Online E-commerce Disputes Resolution Rules in China

  • Chinese e-business enterprises responded to the great amount of e-commerce disputes under the rapid development of Internet technology and the slowing tendency of Internet law development by construction of the online dispute resolution mechanism with Chinese characteristics under the technical support and code control system. The mechanism satisfies the huge demand of e-commerce disputes resolution to some extent, but also has risks on the legitimacy and rationality. Compared with the current status and pros and cons of ODR abroad both in developed countries and developing countries, it is necessary for Chinese e-business enterprises to construct an independent online disputes resolution institute with both multiple subjects and professional and efficient adjudication system within the framework of Chinese civil and commercial law.
