The Application of International Aviation Security Conventions in China

摘要: 为预防与惩治危害民用航空安全的非法行为,国际社会一直致力于航空保安的法制建设,国际航空保安公约已得到各国的普遍遵守。中国国内法对国际航空保安公约的适用缺乏明确的规定,理论与实践上也存在不少问题。中国要重视国内法和国际法的衔接, 明确国际航空保安公约在国内适用的效力,完善国内立法,以更好地履行国际义务,惩治国际航空犯罪,维护国际社会秩序。Abstract: In order to prevent and punish the illegal acts threatening the safety of international civil aviation, the international community has always been committed to the legislation development of aviation security, which culminates in the widespread adoption of International Aviation Security Conventions by various nations. The Chinese domestic laws do not have clear rules regarding the application and transposition of International Aviation Security Conventions, which cause many problems in both theory and practice. By highlighting the interface and interconnection between the domestic law and international law, we should clarify the legal force of applying International Aviation Security Conventions in China, and perfect the domestic legislation so as to better fulfill our international obligation, crack down on international civil aviation crimes and safeguard the order of international community.
