The Use of the Customary Law of Yao Nationality in People-s Mediation: Taking a Case of the Mediation of Drainage Dispute in Jinxiu Town of Guangxi Autonomous Region

摘要: 中国现行的人民调解制度,是继承和发扬中国民间调解的历史传统,在实践中不断完善和发展起来的一项具有中国特色的、重要的法律制度。2008年4月广西金秀瑶族自治县金秀镇司法所、人民调解委员会在一起相邻排水纠纷调解过程中,借鉴瑶族传统的纠纷处理习惯法,吸纳瑶族固有习惯法的现代价值,圆满地解决村民之间的冲突,取得了较好的社会效果。这表明瑶族习惯法在当代中国纠纷解决中是有现实意义的。Abstract: The current people-s mediation is an important legal system with Chinese characteristics. It has inherited and developed the history of civil mediation, and is constantly improving itself in practice. In April 2008, the Judicial Administrative Office and the People-s Mediation Committee of Jinxiu Town, Jinxiu Yao Autonomous County, Guangxi, resolved a drainage dispute through the way of mediation. In the process of conciliation, on one hand they concluded the modern value of the indigenous customary law, and on the other, they used the traditional customary law of dispute resolution in the history of the Yao ethnic group. So they solved perfectly the conflict between the villagers, and got a good social effect.This suggests that the customary law of the Yao ethnic group has an important practical significance of dealing with disputes in contemporary China.
