Construction and Interpretation: Commentary on the Jurisprudential Thought of Dworkin

摘要: 作为美国当代著名的法理学家,德沃金在批判实证主义法学和功利主义法学的基础上,从一种道德哲学的现代立场,构建了颇具说服力的原则学说与权利理论,强调原则应当得到遵守,并且公民也应当享有得到政府平等关怀与尊重的权利。此外,德沃金还运用"内在观点"对法律进行"建构性解释",从而得出了"作为整体性的法律"概念。

Abstract: As a famous American jurist today, Dworkin, on the basis of criticizing positive jurisprudence and utilitarian jurisprudence, has constructed persuasive principles doctrine, which emphasizes that the principles ought to be abided by, and rights theory, which claims that citizens should have the right to deserve equal concern and respect of government, from the modern standpoint of moral philosophy. Thereby, Dworkin also has made the "constructive interpretation" of law from the "internal point", thus elaborating the concept of "law as integrity".
